1. Assumption of Risk
I, for myself and on behalf of my family, heirs, and assigns, voluntarily assume all risks of injury or damage arising from participation in Akron Wing Chun / Victory Defense Systems martial arts instruction, conditioning, and self-defense activities (“Martial Arts Instruction”) — including classes, exercises, partner drills, sparring, demonstrations, and use of equipment — at any location where instruction occurs (“Designated Facilities”), including travel to and from those locations. I understand martial arts training is physically demanding and participate with full knowledge of these risks.
2. Waiver and Release
The undersigned hereby releases and discharges Akron Wing Chun and Victory Defense Systems, including their owners, instructors, assistant instructors, other participants or students, and all Designated Facilities, from all claims, demands, damages, rights of action, or causes of action, present or future, whether known or unknown, anticipated or unanticipated, resulting from or arising out of the undersigned's use (or intended use) of Martial Arts Instruction, Designated Facilities, and equipment. This waiver applies to any incident resulting from engaging in Martial Arts Instruction or otherwise following Martial Arts Instruction anywhere.
3. Indemnification
The undersigned agrees to indemnify, defend, and hold harmless Akron Wing Chun / Victory Defense Systems, their owners, instructors, agents, and employees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, brought as a result of the undersigned's involvement in Martial Arts Instruction and to reimburse them for any such expenses incurred.
4. Health and Medical Authorization
I have no known physical or mental condition that prevents full participation, or I have disclosed relevant conditions on the registration form.
If the participant is under 18:
- I am the legal guardian and am authorized to sign this agreement.
- I confirm the information provided is accurate and give permission for the minor to participate.
- I authorize emergency medical treatment by a licensed physician if I cannot be reached and delay would endanger the minor's health.
If the participant is 18 or older: I authorize emergency medical treatment if I am unable to consent and delay would endanger my health, and I have provided an emergency contact.
5. General Provisions
By agreeing, I acknowledge that I have read this document, understand it, and sign it voluntarily as my own free act and deed. I am at least eighteen (18) years of age and fully competent, or I am the legal guardian of a minor participant (ages 13–17). No oral representations apart from this written agreement have been made.
6. Severability
If any provision of this agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect and enforceable.
7. Governing Law
This Waiver of Liability shall be governed by and construed in accordance with Ohio law.
8. Acknowledgment of Understanding
I acknowledge that I have read this waiver of liability and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am agreeing freely and voluntarily and intend this to be a complete and unconditional release of all liability to the greatest extent allowed by law.
